July 27, 2022An organisation I have a contract with, has taken payment from my Visa debit account without permission. I made the first payment over the phone, providing my card details and signed a contract stating I will pay on time. I cancelled within the first four months, which is within the terms of the agreement. When they received notification of the cancellation, they used my debit card details to take another payment, the card details I gave them over the phone initially. My understanding is, they mustn’t keep my card details on file and use it whenever they wish. Both me and the organisation are in Australia. A lawyer I approached about this, advised:
Yes, you may file a lawsuit and may request restitution of the amount taken plus damages for the unauthorized taking of funds from your account. And you are correct, they cannot just use your account whenever they wish. They need your permission for every use.
Rather than go to the expense of a lawsuit, I would prefer to quote the releant law that states they have acted illegaly. Are you able to provide that detail?
